Sunan at-Tirmithiy كتاب الفرائض باب ما جاء فيمن يرث الولاء
حَدَّثَنَا قُتَيْبَةُ حَدَّثَنَا ابْنُ لَهِيعَةَ عَنْ عَمْرِو بْنِ شُعَيْبٍ عَنْ أَبِيهِ عَنْ جَدِّهِ أَنَّ رَسُولَ اللَّهِ صلى الله عليه وسلم قَالَ يَرِثُ الْوَلاَءَ مَنْ يَرِثُ الْمَالَ. قَالَ أَبُو عِيسَى هَذَا حَدِيثٌ لَيْسَ إِسْنَادُهُ بِالْقَوِىِّ.
The Messenger of God, peace and blessings of God be upon him, said, “The wealth of a freed slave (1) is inherited by the heirs [of his emancipator] (2).”
(1) i.e. if he passes away leaving behind no family. (2) i.e. when the emancipator is no longer alive. The inheritance is only distributed among the male paternal relatives of the emancipator, not the females. A woman only inherits from a freed slave if she is the one who freed that slave.
